Website Terms and Conditions

  1. THE CONTRACT BETWEEN US

1.1    Your order via this website constitutes an offer which can then be accepted by FUEL10K LTD as www.fuel10k.com.

1.2    We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

1.3    FUEL10K LTD will endeavour to process your order within 2 working days. Delivery times are between 3 and 5 working days (or up to 10 Days outside of the UK). FUEL10K LTD will work to ensure that these times are met, however, occasionally if we need to replenish stock this can be up to 10 days. Any issues please call +44 1349865505.

1.4 Please make a note of the items ordered and date of order in case of query.

  1. PRICE

2.1 The prices payable for goods that you order are as set out in our website.

2.2 You may be required to pay extra for delivery outside of the UK and it might not be possible for us to deliver to some locations. For all orders outside the UK please contact us directly on [email protected] or call us on +44 1349 865505.

2.3 Please ensure that your payment is in Pounds Stirling and is for the correct amount, if not your application will be rejected.

2.4 Payment can only be made by the following credit/debit cards Visa, Visa Delta, Visa Electron, Mastercard, Switch, Maestro and Solo. We don’t accept American Express.

2.5 FUEL10K LTD is not responsible for any import duty or customs charges for overseas deliveries.

2.6 SHOPPING CODES From time to time FUEL10K will release discount codes (“Codes”) via email or other marketing channels. These Codes will allow a discount to be applied to your order at www.fuel10k.com only. To apply the code at www.fuel10k.com please enter it where specified during the check-out process. The discount will then be applied to your order.

Please note that save as expressly stated, Codes are only valid on full-priced items and cannot be used on sale items. Codes cannot be used in conjunction with any other offer. Codes are valid for a limited period of time as specified in the relevant email or marketing communication, they cannot be used outside of that time period. Codes are not valid in other stores or concessions. All orders are subject to acceptance and any improper use of Codes may result in the cancellation of your order. All orders are subject to availability. FUEL10K reserves the right to withdraw, amend or extend offers at any time, without prior notice.

Specific offer terms and conditions are provided with each Code – for specific information relevant to that Code, please refer to the email or marketing communication on which it is featured.

  1. RIGHT FOR YOU TO CANCEL YOUR CONTRACT

3.1 You may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

3.2 To cancel your contract you must notify us in writing.

3.3 If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

3.4 Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

  1. CANCELLATION BY US

4.1 We reserve the right to cancel the contract between us if:

4.1.1 we have insufficient stock to deliver the goods you have ordered;

4.1.2 we do not deliver to your area; or

4.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

4.2 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

  1. DELIVERY OF GOODS TO YOU

5.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.

5.2 Delivery will be made as soon as possible after your order is accepted and in any event within
30 days of your order.

5.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

  1. LIABILITY

6.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.
6.2 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:

6.2.1 to make good any shortage or non-delivery;

6.2.2 to replace or repair any goods that are damaged or defective; or

6.2.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.

6.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 6.2 above.

6.4 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

6.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

  1. NOTICES

  1. EVENTS BEYOND OUR CONTROL

8.1 We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

  1. INVALIDITY

9.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

  1. PRIVACY

10.1 You acknowledge and agree to be bound by the terms of our privacy policy.

  1. THIRD PARTY RIGHTS

11.1 Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

  1. GOVERNING LAW

12.1 The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

  1. ENTIRE AGREEMENT

13.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

  1. PRIVACY POLICY

14.1 We are committed to protecting your personal privacy and, in accordance with UK Data Protection law, and we uphold strict security procedures for the storage of your personal information.

14.2 When you place an order we collect your name, e-mail address, mailing address, phone number and credit card information. We may record which products you are interested in and which products you purchase.

14.3 We also monitor customer traffic patterns which enable us to improve the service we provide.

14.4 This information is used to process orders and to provide a more personal shopping experience. We will not use your personal information for any other purpose except to notify you of our special offers if you have selected this option in ‘my account’

Cookies allow FUEL10K LTD to improve your user experience, for example by remembering viewing preferences or displaying your recently viewed items FUEL10K LTD does not use cookies to retrieve information from your computer that was not originally sent in a cookie.

17.1 You will be redirected to www.paypal.co.uk to type in credit card information to the FUEL10K web site. Paypal secure servers ensure all details are encrypted at your browser before they are sent over the Internet.

TERMS AND CONDITIONS for SUBSCRIPTION MODEL

Registration

To sign up for the Services, you must register for an account on the Services (an “Account”). You must provide accurate and complete information and keep your Account information updated. You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a username a name that is otherwise offensive, vulgar or obscene. You are solely responsible for the activity that occurs on your Account, including where money is spent using your up-to-date login details, and for keeping your Account password secure. You may never use another person’s user account or registration information for the Services without permission. You must notify us immediately of any change in your eligibility to use the Services, breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. You have the ability to delete your Account, either directly or through a request made to one of our employees or affiliates.

Ordering, Delivery, Payments and Billing


Paid Services and Terms of Sale

Certain of our Services, including the purchase of any products or subscriptions (such as The Complete Meal plans) offered by us, may be subject to payments now or in the future (the “Paid Services”). Please see below and also our FAQs for a description of the current Paid Services, our shipping terms, and cancellation and refund policies. Please note that any payment terms presented to you in the process of using or signing up for a Paid Service are deemed part of these Terms of Service.

You may place an order for Paid Services at any time (subject to any planned or unplanned downtime). You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the “Submit Purchase” button on the checkout page. An order submitted by you constitutes a legally binding offer given by you to us to purchase the Paid Services specified in that order, subject to these Terms of Service, at the price and on the terms stated when you sign up or place your order. All orders are subject to acceptance by us. Your order will not be considered accepted until we have received payment of the purchase price of your order. We shall send an acknowledgment of our receipt of your order to the email address you provide, after your payment for the order has been processed, so that you may print the information for your records (“Order Confirmation”). Title and risk of loss pass to you upon delivery to the shipping address you specified when you placed the order, provided full payment of all sums due in respect of the product(s), including any delivery charges, has been received.

Our products and services, including, without limitation, our Paid Services, are for your personal, non-commercial use, and once delivered to you may not be resold, redistributed, exported, or used for any other commercial purpose. The rights you have under these Terms of Service are personal to you and are non-transferable.

Please note that we cannot offer refunds, exchanges, or customer service for products that have been acquired from an unauthorized reseller, including, but not limited to, any seller on Amazon, eBay, Muscle Food or similar online marketplaces. 

Delivery

Your order will be fulfilled by the delivery date set out in the Order Confirmation or, if no delivery date is specified, within 5 days after the date of the Order Confirmation, unless there are exceptional circumstances.

Billing

We use a third-party payment processor, Stripe, (the “Payment Processor”) to bill you through a payment account linked to your Account on the Services (your “Billing Account”) for the Paid Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms of Service. More information is available in our Privacy Policy. We are not responsible for errors by the Payment Processor. By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services in accordance with the applicable payment terms and you authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payments using that selected Payment Method. We reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Payment Method

The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.

Subscriptions, Cancellations and Refunds

Consumer Cancellation Rights

You may cancel your order or subscription at any time before an order is delivered or up to 14 days after you placed the order. If you cancel, you will receive a full refund of the price paid for the products in accordance with our Refunds Policy (see below).

To cancel an order, you must clearly inform us, preferably:

• by going to your Account, calling us on 01349 865505, or emailing us at [email protected] giving us your name, address and order reference

You must also return the product(s) to us within 14 days after the day of notifying us of the cancellation, in the same condition in which you receive them (which does not interfere with your right to take any reasonable steps to examine the product(s) and make sure they conform to your order). You have a legal obligation to take reasonable care of the product(s) while in your possession. If you fail to comply with this obligation, we may have a right to deduct the cost of any deterioration (due, for example, to your having used the product(s)), up to the price of the product(s), from the refund to which you are otherwise entitled.

To return the product(s), you should package the parcel securely (making sure you include a note that includes your name and address (enclosing any returns slip, if we have provided one) inside the parcel) and then return it to us, either by courier or by recorded delivery mail or other form of certified mail to the following address: FUEL10K, Brahan, Dingwall, Rosshire, IV78EEUnited Kingdom.

Refunds Policy

If you cancel an order within the 14-day cooling-off period (see above), we will process any refund due to you as soon as possible and, in any case, within 14 days after the day on which we receive the product(s) back or, if earlier, the day on which we receive evidence that you have returned the product(s) to our returns address (see above). We will refund the price paid in full (subject to any deduction we are entitled to make due to your use of or damage to the product(s)), including the cost of standard delivery. However, we will not refund your cost of returning the product(s) to us. If you received any promotional or other discount when you paid, any refund will only reflect the amount you actually paid.

Refunds are made using the same Payment Method originally used by you to pay for your purchase, unless agreed otherwise.

Auto-Renewals and Recurring Billing for The Complete Meal and Other Subscription Services

Some of the Paid Services, such as the purchase of auto-replacing The Complete Meal, may consist of an initial period for which there is a one-time charge or a Trial Offer (defined below), followed by recurring periodic charges as agreed to by you when you sign up for such auto-replacing products (“Subscription Services”). The Subscription Services give you the ability to specify how regularly you would like to order any auto-replacing products. Unless you opt out of a Subscription Service, which can be done via the methods described below, the Subscription Services that you have signed up for will be automatically extended for successive renewal periods of the same duration as the subscription term you originally selected, at the then-current non-promotional rate. By choosing a Subscription Service, you acknowledge that such Subscription Service has an initial and recurring payment feature, and you accept responsibility for all recurring charges prior to cancellation.

Subscription Cancellation

To change or cancel your Subscription Services at any time, go to your Account, call us on 01349 865505, or email us at [email protected] If you terminate a Subscription Service, your subscription will not be renewed after your then-current subscription term expires. It is your responsibility to notify us in advance of renewal.

Current Information Required

You must provide current, complete and accurate information for your Billing Account. You must promptly update all information to keep your Billing Account current, complete and accurate (such as a change in billing address, credit card number, or credit card expiration date), and you must promptly notify us or our Payment Processor if your Payment Method is cancelled (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your user name or password. Changes to such information can be made on your Account. If you fail to provide any of the foregoing information, you agree that we may continue charging you for any use of Paid Services under your Billing Account unless you have terminated your Paid Services as set forth above.

Change in Amount Authorized

If the amount to be charged to your Billing Account varies from the amount you preauthorized (other than due to the imposition or change in the amount of sales taxes), you have the right to receive, and we shall provide, notice of the amount to be charged and the date of the charge before the scheduled date of the transaction. If, on receipt of such notice, you do not wish to continue with the purchase, you may cancel at any time before the scheduled date of the transaction. Any agreement you have with your payment provider will govern your use of your Payment Method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.

Reaffirmation of Authorization

Your non-termination or continued use of a Paid Service (including, without limitation, Subscription Services) reaffirms that we are authorized to charge your Payment Method for that Paid Service. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially selected to use the Paid Service.

Free Trials and Other Promotions

Any free trial or other promotion that provides access to a Paid Service (a “Trial Offer”) must be used within the specified time of the Trial Offer. You will be required to have a valid Payment Method on file in order to initiate a Trial Offer. You must stop using a Paid Service before the end of the Trial Offer period in order to avoid being charged for that Paid Service. If you cancel prior to the end of the Trial Offer period and are inadvertently charged for a Paid Service, please contact us at [email protected]. Trial Offers are one-time only for new customers and are limited to one per household. Additional terms and limitations may apply and will be more fully explained at the time you sign up for the Trial Offer. Termination

Limitation of Liability

Disputes

You agree that any dispute between you and us regarding these Terms of Service or any order will only be dealt with by the English courts, except that if you live in Scotland or Northern Ireland, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.

Governing Law and Jurisdiction

We are required by law to advise you that orders may be concluded in the English language only and that no public filing requirements apply.
